1. Introduction

These Terms and Conditions ("Terms") govern your use of Pepper ("the App"), a private media storage application for iPhone developed and published by an individual developer ("the Developer"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Nature of the App

Pepper is a private media storage application designed for personal entertainment and convenience. The App allows you to store and organise photos and videos locally on your device. The App is not intended as an encryption-grade private vault, secure storage solution, or data protection tool. You should not rely on the App for the secure storage of sensitive, confidential, or critical media. For security, you must always assume that anyone who has physical access to your device may have access to tools to access the data contained within it.

3. Licence to Use

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on any iPhone that you own or control, solely for your personal, non-commercial purposes.

4. Free Trial and Payments

The App is free to download and use up to a specified media item limit. Once this limit is reached, continued use of the App's full functionality requires either a subscription or a one-time purchase. All payments are processed by Apple through the App Store. The Developer does not collect or process any payment information directly. Your purchase is subject to Apple's terms and conditions, including their refund and cancellation policies.

5. User Accounts

Your privacy is paramount to us. The App does not require you to create a user account, nor is it possible to create a user account. No registration, login credentials, or personal identification is necessary to use the App.

6. Your Content

All media you store within the App remains on your device. The Developer does not have access to, collect, transmit, or store any of your media content. You are solely responsible for any content you choose to store using the App and for maintaining your own backups (such as iCloud).

7. Data and Privacy

The App does not collect personal data. However, anonymous usage analytics are collected to help improve the App. This information cannot be used to identify you as an individual. For full details on data practices, please refer to our separate Privacy Policy.

8. Intellectual Property

The App, including its design, features, code, graphics, and all related intellectual property, is owned by the Developer. Nothing in these Terms transfers any ownership rights to you. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse-engineer or attempt to extract the source code of the App.

9. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not use the App to store any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable under applicable law.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. The Developer disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall have no liability whatsoever to you for any loss, damage, cost, or expense of any kind arising out of or in connection with your use of, or inability to use, the App. This includes, without limitation, any direct, indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or any other damages, even if the Developer has been advised of the possibility of such damages. The maximum aggregate liability of the Developer to you under or in connection with these Terms or the App shall be zero (£0).

12. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App or your breach of these Terms.

13. Changes to the App

The Developer reserves the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. The Developer shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Changes to These Terms

The Developer may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms within the App or on the App's listing page. Your continued use of the App following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.

15. Termination

You may stop using the App at any time by deleting it from your device. The Developer reserves the right to terminate or restrict your access to the App at any time, without notice, for any reason, including if the Developer reasonably believes you have violated these Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App and supersede any prior agreements or understandings.
